In accordance to the article 150 of the Wetboek van Burgerlijke Rechtsvordering, you, as a claimant, hold the burden of proving my responsibility for the occurred accident in order to be able to claim any recompense for the suffered damage from me. This requirement remains in power without any regard to the insurance status of any party involved. I must assert that I do not acknowledge any responsibility for that accident. I was cycling with a constant low speed with my lights on, was not doing any manoeuvres, and kept to the right side of the cycling pad. You, on the other hand, were doing a left turn in a situation of low visibility, without ensuring first whether you had adequate space to complete the turn without interrupting the flow of traffic. The nature and characteristics of the damage sustained by our bikes implies the same.
The claim you have sent me is therefore not legally sufficient, and thus I do not accept your settlement proposal.
I am fully willing to reconsider if you would be able to present the evidence that would indeed prove my fault in the accident. I expect you to do that in a form of a written letter, with any evidence enclosed, delivered by the postal service at my address.
I am sorry that this accident occurred, but I also see the fact that you want to hold me liable for a situation where I had no fault unfair.
